State election officials will declare mayoral candidate Mike Duggan the winner of Detroit’s disputed primary election Tuesday after the Michigan Court of Appeals halted a delay in the certification.

The decision reverses an Ingham County Circuit Court order to temporarily block certification until a hearing is held on whether Michigan overextended its authority by recounting ballots.
“The Board must be permitted to fulfill its statutory duty to certify the election results within the 10-day period prescribed” in state law, Judges Donald Owens, Michael Kelly and Amy Ronayne Krause said in the order. “Such action will not prejudice plaintiff’s efforts to obtain a recount if desired.”
The Board of State Canvassers is expected to announce that Duggan beat Wayne County Sheriff Benny Napoleon – and by more votes than originally thought. A tally of the disputed ballots found Duggan received 4,300 more votes than he got in the initial city count, raising serious questions about the city’s ability to oversee an election.
The final state count: Duggan 48,716, Napoleon, 28,391.
State election officials were expected to certify the results of the primary election, which originally was won by Mike Duggan. But when county election officials noticed that more than 18,000 write-in votes were improperly counted, they declined to certify the election results and punted to the state. If the disputed votes aren’t certified, the victory would go to Wayne County Sheriff Benny Napoleon.
No matter what, Duggan and Napoleon will still face off in November.
